Creative Industries in Malaysia: Are the Copyright Reforms Aligned with Economic and Trade Policies?

Abstract


Malaysia’s New Economic Model identified the creative industries as one of the key drivers to attain a high income and knowledge-based economy. The government envisaged that the contribution of creative content industry towards the Gross National Income (GNI) to increase by three fold from RM9.4 billion in 2008 to RM33 billion by 2020. Various policies have been laid out to promote the industry and to make Malaysia as a regional hub for the creative content industry. The National Creative Industry Plan that was formulated in 2009 is one of the key initiatives towards this end, in addition to many other provision of incentives and implementation of plans to attract investment and creating the right ecosystem to further support the industry. The government also has rightly acknowledged copyright policy as an important enabler for systematic and sustainable development of the sector. This is reflected in the various reforms done to the copyright laws and adoption of TRIPS-plus obligations. In addition, Malaysia also has liberalized its trade and investment regimes to facilitate the industry. This paper intends to examine whether copyright reforms are aligned with economic and trade policies that are intended to promote the creative content industry, especially the creative services sector. Our primary contention is that aligning copyright reforms with economic and trade policies are crucial in creating a conducive environment and ecosystem for the development of IP owners, skilled workers and high value-added content in the creative industry. Misalignment in these policies will only delay or derail the realization of knowledge-based economic development strategy.
